unlicensed driver hit child and disappears
My daughter was hit by an unlicensed driver and he carried insurance now we are being told they can find him can the insurance company be held liable for pain and suffering.

It looks as if you are trying to say that they can't find this driver but that you do have insurance info.
In such circumstances, you really don't need the guy. Yes you can go directly against the insurance company. They are required to defend him even if they don't know where he is.
I would suggest, however, that you not try to do this without a lawyer. That would be a big mistake.
