Hello and thank you for contacting the LawGuru!
If you filed a chapter 7 in 2001, you can file another chapter 7 after 8 years, or a chapter 13 after 4 years. If you filed a chapter 13 in 2001, you can file a chapter 7 after 6 years, or another chapter 13 after 2 years. The waiting periods run from the filing date of the first case to the filing date of the second case.
You can actually file sooner than that, but if you file sooner, you will not receive a discharge of your debts. Since the purpose of filing bankruptcy is usually (but not always) to get a discharge of debts, for practical purposes the timelines set out in the first paragraph apply.
I hope this information is helpful. Thank you!
