mental health and power of attorney

HI,

My father who is 79 years old has had a mental breakdown. He and my mother live at seperate addresses. He gets 2 pensions and social security. My mother is physicaly disabled and they both live off of the 2 pensions and social security. He has lost his mind suddenly, and is in the VA hospital. He thinks his bank has hired someone to kill him. My mother is not on his bank account, and the pensions and social security are in his name. He won't cash the checks. What can my mother due ? She has no income except for his checks. Please help!

Will a doctor say your father is mentally competent to sign a durable financial power of attorney to you? Your mother should also sign one to you as well. If he is not competent, you will need to institute a guardianship over your Dad. I note you are in Fairborn. Joe Balmer in our firm could assist if you need assistance.
