Legal Question in Appeals and Writs in Ohio
First Time Offender
My husband is currently incarerated in Athens county Ohio. He isan alleged first time offender(GSI). He was sentenced in July of 2003 for a 5 year term. Is there any law currently in affect in OHio that may help to have him released. OR recently passed. How can we help to have him realeased? He is a good man.

It appears that your husband was sentenced to the maximim prison term of five years for a third degree felony. Unfortunately, he cannot file for judicial release until he has served four years. However, he may be able to file a delayed appeal of his sentence. The likelihood of success would depend upon the findings that the judge made at the sentencing hearing and whether or not such findings are supported by the facts. I would certainly be happy to discuss it in more detail.
