Legal Question in Bankruptcy in Ohio
Argument ot preferential payment determination
We are a small trucking company in Ohio being sued for return of ''preferential payment'' over $8200.00 from a bankrupt customer based in NY. We don't believe the payment was preferential as it was incurred in the ordinary course of business according to ordinary business terms. Regardless, we do not have the money. We lost money the last 2 years, and are struggling to keep the doors open now. What is our best option to fight this?
