Legal Question in Bankruptcy in Ohio
Cash Advances
I am currently in a mess with 3 cash advance places. I plan on filing bankruptcy in February because I believe that is the first time that I am eligible. I filed twice before with the most recent being in February of 1997. I have many medical bills, credit card bills and misc. bills. My biggest concern is places like Cashland, National Cash Advance, Advance America, CheckSmart, etc. that give you a payday advance. They ask you to sign a paper stating that you are not currently filing bankrupcty or if you plan to... is this something that I cannot include in my bankrupcty? Any legal way to get out of it?

If you just filed a Chapter 7 bankruptcy in 1997, you are not elgible to file another Chapter 7 until 2004. However, if you are filing a Chapter 13, the debt is considered unsecured and is listed on Schedule F with your other debts. It will be repaid in full (or a portion) through your Chapter 13 plan.
