Ex courted ordered to pay debts, wants to file bankruptcy

My ex-husband was ordered to be responsible for a couple of debts through our dissolutionment. These debts are listed in my name. He now claims he is going to file bankruptcy to keep from going to jail for non-payment. Can he file bankruptcy on debts in my name?

Yes, he can, although bankruptcy will not shield him from possible contempt charges, only delay their enforcement. You also might want to hire someone to contest their dischargeability in bankruptcy court.

Yes, marital debts can be discharged through bankrupcty. a former spouse may object to the discharge and the court may not allow the debt to be discharged if certain criteria are met. consult an attonrey.
