Dear Inquirer: The filing of a Bankruptcy will impose an automatic stay on all litigation, as a matter of Federal Bankruptcy law. However, any one of the other parties may petition the Bankruptcy Court for a Relief from Stay, to permit the action to proceed without the bankrupt petitoner (person or entity).
Consult experienced legal counsel to assist and advise you ASAP. Good luck. Sincerely, J. Norman Stark
