Can i File Bankruptcy if my husband has already filed?
my husband filed for chapter 7 in october of 2001.he filed seperately and all debts that we listed were solely his.now i have gotten my self in to alot of debt by making wrong choices etc and need to know if i can file chapter 7.Also i just got my green card approved is this going to affect anything to do with that?if i can file will it affect my husband as the debt is only mine.

You must be a citizen of the United States in order to file bankruptcy. If you are, then you have the right as any other American Citizen to file. Since your husband filed a Chapter 7 less than 6 years ago, he would not be eligible to file with you; however, there may be a problem if the debts are in both your names.
