Legal Question in Bankruptcy in Ohio
I can file bankruptcy, my husband filed less than 5 years ago, so he cant right now. Our home is in foreclosure, and its in both our names. We dont want to lose it, can I file chapter 13 to try and save the home without him filing ?

Yes you mail file a bankruptcy case without your husband. It will stop the foreclosure. You need to act before the house is sold in the foreclosure court so don't delay.

In fact, your husband can file a Chapter 13 as well since he is outside the waiting period. But you should act quickly to ensure it is not sold in a sheriff's sale. If you are in Northern Ohio, you may call us at 216-241-2510 or by cell at 216-310-1439 for further consultation.
