Legal Question in Bankruptcy in Ohio
Finding debt after a discharge
In march of '04 our house foreclosed, we moved out of the county, and in aug '04 we filed chapter 7 and were discharged in Jan '05. A lein of the remaining debt from the home was put on us in Apr '04, but since moving out of the area, we never recieved this knowledge until after the bankruptcy was discharged. Can I reopen our case to rid us of the lein or is their another solution? It is a substantial amount of money! Thanks

Yes, you can file a motion to reopen the case with the bankruptcy court, but you must notify all of the creditors currently, whether original or not.
