Legal Question in Bankruptcy in Ohio
Foreclosure
My husband and I are losing ...or have lost our home...We filed Chapter 13 in hopes to save it....We called our attorney
two days ago and they said that it had been filed and the sale had been stopped. Today was the sale date and my husbands cousin called and said he purchased the house. What do we do ?
I mean if the lawyer said the papers had been filed....are we really losing our home?

Did you or your attorney file a notice of the bankruptcy with the court hearing the foreclosure? If not, you need to do this immediately before the sale is confirmed. The creditor might file a motion for relief from the automatic stay, but at least you will get some time to straighten things out.
