Legal Question in Bankruptcy in Ohio
my home
we are filing a chapter 7 this week...what about the home. if we do chapter 7 and dont make anymore payments ? can you file chapter 7 on your home? how long do you have to move ? or is this just a foreclosure?

If you file a Chapter 7, and do not continue to make the payments, then the mortgage company will file a motion for relief from the bankruptcy stay, and initiate foreclosure proceedings. Even if you do make the payments, you are only entitled to 5K credit max in accrued equity.
