Legal Question in Bankruptcy in Ohio

Can I include cell phone service in bankruptcy?

Hi, I recently declared bankruptcy on December 30,2002. I have not gone to court yet for the meeting with the creditors. I was wondering if I can include my cell phone service through Verizon Wireless on my bankruptcy? I am delinquent on the bill. Also on the customer agreement for Verizon it states they can cancel my service if they find out I'm bankrupt. Would I have to pay termination fees if they did that? Verizon is on my credit report. Please email me back. Thanks in advance.

Re: Can I include cell phone service in bankruptcy?

Yes, your cell phone should have been included in your original bankruptcy petition. Your attorney should have caught this. If you are under a contract with your cell phone company, it needed to be reported on Schedule G of your petition and added to your Schedule J (monthly budget) if you planned to keep the contract. However, if you decide to reject the contract (which it appears you want to do), the bill should be listed on Schedule F including all the disconnect charges so it can be dismissed.

I urge you to contact your attorney and ask him or her to file an Amendement to Schedule F to include this creditor.
