It depends on the nature of the lawsuit. Generally, the following are not dischargeable in bankruptcy:

1. Debts for trust fund taxes (i.e., sales and withholding taxes)

2. Taxes for which returns were never filed or were filed within two years prior to

bankruptcy case filing

3. Taxes for which debtor made a fraudulent return or evaded taxes

4. Debts incurred through fraud or false statements

5. Debts not listed in the bankruptcy

6. Embezzlement by a fiduciary

7. Domestic support payments

8. Student loans

9. Injuries arising from drunk driving

10. Criminal or civil restitution

11. Fines and penalties

12. Willful or malicious actions causing personal injury or death
