Legal Question in Bankruptcy in Ohio
My mother is supposed to inherit a portion of the procedes from the sale of her mothers house upon her death. My mothers sister is also supposed to inherit a portion. However, the sister filed bankruptsy recently and the bank that she owes is threatening to to take ALL the proceeds from the inheritance and sale of the house even though it is supposed to be divided. Can they do this even though the inheritance is not supposed to go soley to the debtor?

I do not practice bankruptcy law, probate law, or estate planning law; therefore, I am not going to be able to answer your specific question, nor will I be representing you. I urge you and your mother to consult immediately with other lawyers regarding your mother's potential legal rights. Your local bar association may have a lawyer referral service that can provide you with the names of some lawyers near you who handle these types of matters. In the alternative, you may want to contact the Columbus Bar Association Lawyer Referral Service (telephone number 614-221-4112; web address http://www.peoplesbar.org/findingalawyer/referral_form.php). I am sorry I cannot help you.
