Legal Question in Bankruptcy in Ohio
Obligation of responsible officer for withholdings and worker compensation premi
My father was the responsible officer for a company that stopped operating in 1996. The company filed w/h and workers comp returns timely, but did not pay the taxes (I think), for 1995 and Q1 1996. We do not have the records and can only go on what the state is saying.
Subsequently, my father filed personal bankruptcy (later 1996). Is his obligation discharged? The company did not file for bankruptcy.
Any help is appreciated. The state is just now coming back through collections.

It is very difficult to answer your question with reviewing the petition. I advise you to get a copy of your dad's bankruptcy petition from the Bankruptcy Court and look it over. All debts listed on Schedule F should have been discharged but you also need to examine the Trustee's Final Report.
