Legal Question in Bankruptcy in Ohio
Can you please tell me what the process is, in Ohio, to allow a mortgage company to foreclose on your home if you have already file bankruptcy relief ( 2 years ago). I thought I would be able to keep up with my mortgage if I filed Chapter 13, however, being a single parent, having an older home, and living in an economically depressed area, this is no longer possible. Does the mortgage company go through the same lengthy process after they get a Stay of Relief from the court? Every time I am a few days late with my mortgage payment they file a 30 page document with the court. Thus far I have manage to catch up, however, I do not believe my bankruptcy attorney wants to discuss this as an option.

You may want to discuss surrendering your home with your attorney and possibly converting your case to a Chapter 7.
