Legal Question in Bankruptcy in Ohio

property taxes

When filing bankruptcy, chapter 7, where I will pay back my debts. Can I include property taxes on a house that will be mine. My mother died and did not have a will. I have one sibling and she and her husband want me to have the house. There are back taxes to be paid before that......can I include them on my bankruptcy. At the current time, the house is still in my mothers name. I am ready to file and need to know if I can include this or will I lose the house anyway.

It sounds like you should be filing a chapter 13. Depending on your income, whether your sibling will sign a disclaimer of inheritance on the house, whether you intend to reside at the house, and other factors, it may be possible to formulate a chapter 13 plan that would allow you to pay the property taxes over time. If you file a Chapter 7 BK, you will lose the house, as the trustee will want to sell it to pay off debts. Chapter 13 is the preferable option, as you can keep the house, even though you must pay off a percentage of your debts.
