Legal Question in Bankruptcy in Ohio
Statute of Limitations
I filed chapter 7 bankruptcy 1/11/91 and the case was terminated 5/22/91. 8/8/02 I recieved a call from an acquisition company telling me that I must pay a debt from that time period on a credit card. They brought up the statute of limitations. I can't find any information on this. I have never recieved any communication from this creditor in the eleven years since the bankruptcy. If this creditor was missed, is there a statute of limitations on this debt?

Go back to your bankruptcy, and see if the debt was discharged in the paperwork. If not, the statute of limitations which applies here is that of a written contract, which is 15 years.
