Legal Question in Bankruptcy in Ohio
Unclaimed Secured Assets after discharged bankrupsy
I just had a basic question about my bankrupsy..
and I didnt like the answer I got from my lawyer..
(which was ''If you havnt heard from them by now,
you probably wont.. I'd just do what you want to.'') I
just wanted a second oppinion.. it's a very basic
question..
My bankrupsy has just discharged.. and the
creditors still have not taken the secured property
(a music keyboard, and several pieces of
furnature that I am paying to have stored in Ohio.. I
recently moved to CA)
can I sell it ?
It's very expensive to have it in storage, but I didnt
want to take it out of state and look like I was trying
to flee with it or something..

Re: Unclaimed Secured Assets after discharged bankrupsy
You should call the lender to advise them to pick up the collateral and advise them that you do not want to pay for storage costs. You should give them an opportunity to pick up the collateral (and even have them pay for the storage costs if you can). Your personal liability ended once you received your discharge but you should not sell the collateral without first notifying the lender of your situation. Good luck.
