Legal Question in Bankruptcy in Ohio
Hello, I have an wage garnishment against me, I have been paying 25% out of each paycheck. Once I file for bankruptcy can they still come after me? Also will they take my federal income tax money?
1 Answer from Attorneys
As soon as you file a bankruptcy, the wage garnishment stops and you come under the protection of the automatic stay, assuming you are eligible for this protection. Depending on why the wages are being garnished, you may be able to discharge the judgment entirely with a bankruptcy filing. Whether your tax refund can be taken will depend on the amount and source (child care credit, etc.) of the refund.
