Keep in mind that opening and closing statements are not evidence, and will not be considered by the factfinder. If you have to establish any affirmative defenses by producing operative facts, you can only do that by using authenticated documents or by testifying as a witness. There is a risk of cross examination, but testimony is the only way to truly get your version of events into evidence, assuming you can offer a perspective that other witnesses cannot. Also, remember that your credibility as well as veracity may be tested by cross examination.
