Company Expense Reimbursement
Is it illegal for an employee to purchase office equipment for personal use on Ebay for a reduced amount and then sell it to his employer at fair market value and keep the difference? The employee is not an officer of the company. He is the accountant. Thank you.

If an employee purchases equipment and then sells it to the company they work for, they should be able to sell it for any amount they and the company agree to, as long as they don't misrepresent the amount they paid. If, on the other hand, the employee purchases equipment as an approved expense, and submits a fmv value instead of the actual costs on an expense report, they might by filing a false or fraudulent expense report. I would think this might give rise to a claim against them or a cause for termination.
