Convenant to Not Compete

I want to go for a position as a sales assistant at another broadcasting company. I am currently working at another company.I was hired as a radio account executive on August 1,2000 at the company I am at now. I am now an internet sales account executive. I did sign a covenant to not compete form. What can I do in order to go for this other job? The job that I am looking at is more fit for my amount of experience. Am I stuck?

The written terms of the agreement that you signed are key. They could define scope of work, the geographic area of limitation, and the time period. It is possible, too, that the agreement is too restrictive -- that what the agreement purports to prevent it may not really be allowed to prevent. Courts will honor a properly drafted and bargained non competition agreement (in Ohio), but will not honor one that over reaches.
