Legal Question in Business Law in Ohio

A couple of years ago i applied for a walmart discover card online. shortly after my dad applied for the same card at the store. He was denied and they sent me a card. I used the card made payments on the card. I got laid off from work and was unable to pay, I tried making payment arrangements but they would not work with me. They sold my debt to Arrow finance and they sold it to Midlen Funding, now Midlen has obtained a laywer. The Problem is some how mine and my fathers information got mixed up. We have the same name and live on the same street. They now have the card under my dads SS# and birth date. It was under mine because when I made payments I gave them my SS# and birth date to access the account. The debt is mine, i tried explaining this and I was willing to make payment arrangements but they refuse. How do we get this debt out of his name and into mine.

Call the Ohio Attorney General's Office Consumer Division. They may be able to straighten this out for you.

Also, get substitute social security cards from the Federal Social Security Administration. Further, hire a consumer lawyer to write a letter to the plaintiff's attorney to explain the situation and then have this lawyer contact the three credit reporting services to put them on notice that your father's indebtedness is a mistake and he wants to appeal it.
