Legal Question in Business Law in Ohio
how do you get a court order to recover equimpent you leased?
1 Answer from Attorneys
Dear Inquirer: You may have to retain legal counsel to file a replevin action (lawsuit), with request for attachment before judgment, in order to secure the leased equipment, and prevent some scoundrel from removing it from the jurisdiction of the court. I can recall one instance where the lessee actually repainted the large excavator in a different color, to avoid detection and attachment by the Sheriff. (But, we got 'em!)
You'll need a signed copy of the lease (contract), a complete description of the leased equipment with serial numbers or other identification.
Your request for attachment before judgment may require you to post a bond in order to have the Sheriff actually tag the equipment for attachment.
I suggest you contact an experienced Attorney ASAP.
Good luck!
Sincerely, J. Norman Stark, Cleveland, OH.
