Legal Question in Business Law in Ohio
non-compete clause
In May I signed a contract with a non-compete clause since that time I have signed a new contract with new terms and no non compete clause. Is the old contract still in effect or is the new contract the binding contract?

Re: non-compete clause
As with most issues involving contracts, the language of the contracts is key. Does the first one have a clause discussing amendments or new contracts? If so, that can impact the validity of the second contract. Does the second contract have any language that speaks to previous contracts? If so, that can affect whether the first contact would still have any effect. And of course, there is always the interplay between the language in the two contracts to consider.
Unfortunately, I can't give you and straight "yes" or "no" answer on this without seeing both contracts and looking at the language in each. I recommend you speak with an attorney and provide him or her with copies of each contract to review and see what advice he or she might be able to give you.
