I have a new product and want to know what is the legal way to name it. is there a way to search names online and see what name i can use?

Depending on what your product is you may be able to get copyright and/or trademark protection. There are online copyright and trademark registration databases you can search. You can find these databases on the following sites.

http://www.copyright.gov/ (copyright)

http://www.uspto.gov/ (patents and trademarks)

To the other attorney answer, any franchise attorney will say copyright does NOT protect a name. A search of the records at the USPTO website will show who has registered a particular name federally. But a more comprehensive search by state, etc. is also a good idea because not everyone does a federal registration. Consult with a good franchise attorney or business attorney in your area for specific advice.
