Legal Question in Business Law in Ohio

Question about a vehicle purchased.

I was needing advice as what to do. My husband purchased a truck though a car dealer, two days ago. He did not consult me about it. We have 2 house payments, and we just can not afford it. I went back to the dealer, to see if i could get my other car back, that was traded in for the truck, but they refused, it, and said i must have my husbands signature, then they would release my car. My husband came home from work, and we returned to the car dealer. The manager, said that there was nothing he could do, that it was a done deal, the papers was fed exed to the financing place. They said our car was probably already sold. I thought that a person had 3 days, to return something. So basically, thats my question, if there is any certain time limit to return something?.. I am so menatlly stressed. Please help. Thank You.

I was hoping that someone who knew more about this than I do would reply. I hope that someone else does reply. Still, I felt compelled to reply because I can see your concern.

Please look at the sales papers that your husband signed. Did the right person sign it on the dealer's side? I believe that the 3-day return rule that you mention is the one that only applies to things sold to you at your home. But, see if a policy is in the signed papers. It may be hard to prove, but did the dealer misrepresent anything to your husband? I'm guessing that the car was in his name, alone.

Your car is probably gone. If not sold to a consumer, it may be on auction somewhere. The reality, too, is that the new car has lost some value. It would cost money to get the old car back, and selling your new car back as a used car (even 3 days old) is also costly.

It is probably hard to get the dealer to help, and this may not be exciting enough (or, your privacy may be more important to you) to get a local TV station interested. Off hand, I don't see any issues for the Better Business Bureau.
