Legal Question in Business Law in Ohio

Register Business Name

I have been in business as a sole proprietor for 18 years here in Ohio and have had insurance, a bank account and workers comp in my business name for the duration. Now a company I am doing business with is requiring that my business name be registered with the state, which I don't think was done initially. My business is not a field which requires a license (Floor Covering). My question is, am I required to register my name with the state of Ohio? Or are there ways around having to register it? If I am required, what is the procedure in Ohio? Thank you very much for your help...

Just a note you do not need to file articles of organization if you want to continue to operate as a sole proprietorship. You only need to file a trade name registration, which is a very simple form.

Dear Flooring contractor: Registering your trade name should hold no fear for you. It's an orderly procedure.

Contact the Secretary of State, verify availability of your specific business trade name. Then, obtain the application forms, submit them with the fee, along with the Articles of Organization, which contains the business structure, i.e. Directors, Officers, voting capital, etc., a statement about your business generally, and you will be issued a registration.

I recommend you retain an experienced Attorney to advise, assist and guide you through the process.

If you are operating as a sole proprietor and use a name other than your own you need to file a trade name registration with the secretary of state. You can check out the secretary of state website for more information.
