Legal Question in Business Law in Ohio
Restaurant Will Not Repay Loan
A $1000.00 loan was made out to the general mgr of a restaurant and desposited into the restaurant's bank account. The loan was to be repaid within 5 business days (verbal agreement). The manager was fired the next day (unrelated issue) and now the establishment insists that the manager must repay the loan out of his own pocket. He does not have the money and insists that his former employer owes us because he deposited the funds into the business' account and was acting on behalf of said business. Is small claims court our best recourse and if so, how likely is it we will prevail? Thank you.

Re: Restaurant Will Not Repay Loan
Small claims will probably be the best court to sue in, however, you should have corroborating testimony. In other words, you should have someone who can back your testimony through first hand testimony.
