Legal Question in Business Law in Ohio

Small Claims out of State

I have a dispute with a company in Twinsburgh, Ohio. It involves a warranty that is not honored and I am in California. I would like to take them to small claims court to recover the cost to purchase the item from a different company. The problem is I am in California. How do I go about filing a small claims case with this company in Ohio when I am in California?

Thanks!

Re: Small Claims out of State

I would check to see if the company "does business" in California. In other words, if the company sells products in California, it may be sufficient to sue in California.

Should you still want to sue in Ohio you will need someone to testify on your behalf to present your case.

Good Luck!!!!

Re: Small Claims out of State

You should find out first if the company has an agent for the service of process in California. You may be able to get jurisdiction in a California small-claims court if they have an agent and the level of their business activity here is sufficient (sales reps, distribution facilities, etc. usually suffice).

You should get a small-claims self-help book and study the material on suing out-of-state corporations.
