Legal Question in Business Law in Ohio

starting a business w/o legal problems

I work for a non-profit and wish to leave and start an agency of my own. Currently we don't have a non-conpete however, they are installing a new policy in Jan. If I move right in and begin as a competative business can they sue me. I have started 4 new programs for them in the past 2 years and plan to provide the same service as well as a few new ones on my own. Is this an issue? I could begin immediately and start the newest project they have planned before they get a chance to is there implications to this or is it free interprise?

This is difficult to answer in one sentence.

I need more information...mainly how close your new business is to theirs, and how much you are taking from this business and moving to the new one, including clients, work-product ideas...

Dear Eager Beaver: Before you try to "get the jump" on your former employer, be aware that appropriation of confidential business information and trade secrets, including ideas, customer lists, etc., may be considered criminal acts, and punishable under the laws of Ohio. My suggestion is if you wish to start off on the right foot, consult legal counsel, or you may fimd yourself facing a large lawsuit, with stiff mionetary penalties, or a restraining order that will stop you dead in your tracks, and without employment.
