how do you go about sueing a company
I own a small business which isn't getting paid any money for members working out in our gym , the company that ran a marketing promo is not giving us our split we are to be getting 10% right now we have only recieved on check i have contacted them and they say that they would find out what is going on but no anwsers yet , is this grounds to sue this companey?

If you have a contract with the other company, and they are not living up to the deal, you can sue them for breach.
