If I throw something away and someone else takes it out and sells it do I have a lawsuit

As a Franchise Attorney I must ask. A lawsuit for what, exactly? You threw it away, which essentially waives any right to title at that point. You can always sue anyone for anything - but will you prevail and at what cost? Consult with a good business or franchise attorney in your area for specific advice.
