Legal Question in Business Law in Ohio
Trade Secrets
If a company has developed a new process and a key officer familiar with the process, development plans and marketing plans,leaves the firm:
1) Can he take that info to his new employer who is a competitor of the firm he is leaving?
2) Can the new firm use this information to create their own product?
2) There has been no registration or application for patent and the employee does not have a non-compete clause in his employment contract.
3) This is part of a case study exercise for a college course in management.

There is a statute that covers trade secrets. If one takes efforts to protect a process, then the process is protected.
