Legal Question in Civil Rights Law in Ohio

My ex used my computer without my knowledge and saved his login and password. By happenstance I stumbled upon the login and password. Can I use saved emails from my ex's account in court or is he protected under wire tapping and/or privacy laws?

I don't think their is a clear cut answer at this point. Fourth Amendment search and seizure law applies to States and other government entities so a Fourth Amendment analysis isn't likely going to get you anywhere.

Logically, if your husband saved his log/pass info on your computer and accordingly his emails were open to any user of the computer than he has no expectation of privacy.
