Legal Question in Civil Rights Law in Ohio
Sexual Abuse - Children
Can a civil law suite be filed against aa offender that sexually abused children? Does the offender have to have been found guilty of the crime, before you may go forward with a suite? The victims are 16 and 13 year old boys, which report that this abuse started over seven years ago.
Thank you.

Re: Sexual Abuse - Children
The children have a civil lawsuit against anyone who harms them, including the example you give. It is not necessary that there be criminal charges either filed or proven. The proof requirements of a civil suit are different than those for a criminal charge. It takes, however, courtroom-quality evidence in either case to prevail.
