Legal Question in Technology Law in Ohio

Is it illegal to only view the contents of a website that falls under 18 U.S.C 2252 (B)(b). Not to print,download,save,send by e-mail or possess in any way. just to visit a site and view. Thank you.

I believe this is a follow-up question to the one you asked earlier regarding animated child pornography. As stated earlier, the Protect Act of 2003 makes such porn illegal in the U.S.

I may have given you the wrong citation earlier. 18 USC 2256(8) defines what is considered "child pornography" which includes computer generated images. 18 USC 2252A defines what activities are prohibited regarding "child pornography" (as defined in 2256). Under 2252A(a)(2), it is illegal to receive such materials, including by computer. One would have to research and look at case law to know whether opening a website is considered "receiving" the materials, or whether one would have to download the materials to be "receiving" them.

I am not an expert in this area of law, nor have I done specific research into this issue. If you believe you may be in violation, you should seek an attorney in your area to do some research for you and give you an opinion.
