is is illegal to tape conversations without someone knowing you are taping the conversation.

Go to http://www.rcfp.org/taping/index.html
You will find there a list of the States and they will be identified as one- or two-party States.
If a State is a one-party State, you will not need the consent of the other party to the conversation.
If a two-party State, you will need the consent of the other party before you tape.

Only over the telephone, in some states, but it is horrible PR.
