Underage consumption
My 20yo son is being charged with possession of alcohol. The police arrived at his house about 10am on a Sunday morning looking for information on an unrelated issue which does not affect my son. They found beer cans and blood on the back step. My son was asleep & did not hear them knock. The police then entered my sons unlocked house and woke him up at gun point(they said they were looking for a dead body, but there wasn't that much blood). My son was unaware of what was outside until the police showed him. My son had went to bed & 2 of his friends were there watching TV. After asking around here is what happened. After my son went to bed a couple more people showed up & they went outside & drank. A known trouble maker showed up & there was a fight. The friends admitted to that. Now, 1 month later my son was notified by certified mail he is being charged with possession of alcohol. They day of the original visit there was no warrant, no charges. Also, my son owns this house. It is private property. Is my son being hung out to dry on this? I am not sure how much of this is legal. He did have a possession of alcohol charge about 8 months ago. He was rear ended & had an unopened 6 pack in the trunk. He had not been drinking.

It sounds like he has a decent suppression issue as to whether they should have been on the property, but the blood/fight may have allowed this. We have to see what the police report says.
