Legal Question in Construction Law in Ohio
I am a contractor with a house contract gone wrong. The supplier has recorded a lien on the homeowner for non-payment, can they collect from us the builder also? Can they collect from both parties with a lien already recorded?

Dear Contractor: Your supplier may collect only once - whether from the homeowner, or the builder. If the Owner asks him to foreclose on his lien ,the supplier will have to file suit in court within a prescribed period, or face dismissal of the lien. However, the supplier may also sue the builder for non-payment, and the builder may have to join against the non-paying owner, etc.
