Legal Question in Construction Law in Ohio
was hired to paint a house with vinyl siding...we weren't sure what the proper paint to use so the agreement was homeowners get the vinyl siding paint from the paint store themselves because they also needed to pick a color ...paint store sold them the right paint but failed to tell the homeowners that a dark color will warp and ruin the siding...homeowner wants us to replace all siding now thats it warped...who's liable? the painters or the paint store?

You may have more liability here than you think. Part of this depends on your contract with the homeowners. Part of it depends on whether you or the average painter should have known this was going to happen. Part of it depends on whether you have an actual place of business or run work out of your home. You might owe the homeowner three times the amount of the replacement cost under Ohio's consumer laws. I would really need to know more to give you a better idea of your liability.
