Re: owner liability when using contractor
Dear Owner:
DO NOT!!!! It is unfortunate that your proposed contractor doesn't have insurance and proposes to use a friend's coverage, however, that's a form of intentional misrepresentation that amounts to insurance fraud and you may be personally liable for both civil and criminal charges.
DON"T!!!
Find another, insured and bonded contractor. And insist on both a written contract, with proof of Workers' Compensation coverage, insurance coverage and performance and payment bonds for your work so you may be secure in your investment.
Good luck.
Sincerely,
J. Norman Stark, Cleveland, OH.
