I have a retirement plan at work in which I have X amount of dollars taken out my check. the amount is being deducted but not being placed in the fund. This has been going on for quite some time. i have the statements, paycheck stubs to show this. is there anything that can be done legally in this situation?

Re: retirement program
If in fact you have the documentation, you could go after the employer for theft. This could also be a criminal case.
I would contact counsel to investigate.
Re: retirement program
This could be criminal matter, so you could go to the county prosecutor. There is some state agency you could contact through the secretery of state to notify them and begin an investigation.
You could try to litigste against them in some fashion.
