Legal Question in Construction Law in Ohio
If a roofing contractor enters into an written contract agreement under the name "ABC Company" that has printed registered, bonded, and insured but is not, but indicated on the contract that they will pull the permit but instead pulls a permit under a different name "Jack's LLC", (is registered, bonded, and insured). Is this a valid contract?
1 Answer from Attorneys
The contract itself may be valid, the question is who your contract is with. Are these companies related? Is there a problem with the work? Is one a subcontractor of the other? Depending on how you decided to hire this company, the contract may be voidable, and you might be able to get out of it before or after work is done. In order to know whether you have rights in this area, you need to contact an attorney who is knowledgeable in consumer law. There may be a larger issue here than a simple contract dispute.
