Legal Question in Consumer Law in Ohio
Auto Dealership trade in law
I traded in a vehicle for a new vehicle this past week. The delaership called me the day after I had picked up my new vehicle and said that they found frame damage from something hitting the undercarraige of the car. They said they needed to rescind the deal due to the damage. I was never aware of the damage to the vehicle nor remember ever running anything over that would cause damage to the vehicle. I bought the car new; with about twenty miles on it. I drove to the dealership three days in a row with the trade in and they had inspected the car prior to the transaction taking place. They also asked that I file an insurance claim to get the damages repaired. I don't feel comfortable doing this for two reasons. First, I don't recall ever causing any damage to the vehicle; it could have been there prior to me buying it new or could have happened when the car was in service (if someone else drove the car and caused the damage). Secondly, I gave them every opportunity to inspect the vehicle, the car was never in an accident (at least to my knowledge)(I never loaned out this vehicle either), and I beleive that it is now there problem. I need to worry about them paying off my loan on my trade in and the new title. Thoughts?
