Legal Question in Consumer Law in Ohio
Breach of Contract??
In September 2006 I signed up for 3 years at a gym that was to open in January 2007. When signing up they charged $375 on my credit card and the contract says the next payment was to come out January 1, 2007, which I was told to be the opening date. This gym just opened May 14th. I want to cancel the contract since I was told it was to open in January and it just now opening in May. Do I have anything legal to stand on? I talked to the gym manager and he will not budge to give me my $375 back. Any info would be appreciated!

I need more facts but you could easily have a good lawsuit under Ohio's Consumer sales Pratices Act. It may be possible to get you more than $375.00 back and also an award of attorney's fees is possible. If you wish, feel free to call and discuss this further.
