can an elderly person pay a family member to care for them in their home so they won't go to a nursing home

In Ohio, any person can do anything he wishes so long as it isn't illegal. Hiring someone else to look after your personal needs is not illegal. The only hitch would be if the person hired is ineffective at the job and the elderly person's mental or physical state puts him/her in physical danger. In that case, someone could petition the court to take custody of the impaired person and make the proper living arrangements.
